Terms of Service

1. Definitions
- "TAGVU", "we", "us", or "our" refers to TAGVU-TAILORMADE, a company registered under Belgian law.
- "Platform" refers to the TAGVU web application accessible at app.tag.vu, backstage.tag.vu, api.tag.vu, and developers.tag.vu, as well as the TAGVU mobile application.
- "Tag" refers to a physical NFC or QR-enabled product sold or managed through the Platform, linked to a digital profile.
- "User", "you", or "your" refers to any individual or entity accessing or using the Platform.
- "Account" refers to a registered user profile on the Platform.
- "Solution" refers to a specific TAGVU use case configuration (e.g., Pet Tracker, Medical Alert, Luggage Tag, Asset Tracker).
- "Finder" refers to any person who scans a Tag without being the registered owner.
- "Owner" refers to the registered owner of a Tag and its associated digital profile.
- "Company" or "B2B Customer" refers to a business entity with a company account on the Platform.
2. Acceptance of Terms
By accessing or using the TAGVU Platform, purchasing Tags, or creating an Account, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform.
These Terms constitute a legally binding agreement between you and TAGVU-TAILORMADE. For B2B customers, additional terms may apply as set forth in your individual service agreement, which takes precedence over these general Terms in case of conflict.
You must be at least 16 years old to create an Account. If you are under 18, you represent that you have obtained parental or guardian consent to use the Platform.
3. Account Registration and Responsibilities
To use certain features of the Platform, you must create an Account. When you register, you agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your Account information to keep it accurate.
- Maintain the security of your Account credentials and not share them with third parties.
- Accept responsibility for all activities that occur under your Account.
- Notify us immediately at support@tag.vu if you suspect unauthorized access to your Account.
We reserve the right to suspend or terminate your Account if any information provided is inaccurate, false, or no longer current, or if you violate these Terms.
4. Tag Ownership and Usage
4.1 Tag Activation
Upon purchasing and activating a Tag, you become the registered owner. Ownership is tied to the Account that activates the Tag. Tags cannot be activated without a valid Account.
4.2 Tag Profiles
You are solely responsible for the content you add to your Tag profiles. This includes but is not limited to contact information, pet details, medical information, and any uploaded images or documents.
4.3 Tag Transfer
Tag ownership may be transferred to another registered User through the Platform's transfer function. Once transferred, the previous owner loses all access to the Tag and its associated data. Transfers are irreversible.
4.4 Co-Ownership
You may invite other Users to become co-owners of your Tags. Co-owners have access to the Tag profile as defined by the permissions set by the primary owner. Co-ownership can be revoked by the primary owner at any time.
4.5 Lost Mode
When a Tag is set to "Lost" mode, finders who scan the Tag may be presented with contact information and a finder form. The Tag owner controls what information is visible to finders. Location data from scans may be collected and shared with the Tag owner during Lost mode.
5. Description of Services
TAGVU provides a platform that connects physical NFC/QR-enabled Tags to digital experiences, including:
- Tag Management: Create, edit, and manage digital profiles linked to physical Tags.
- Scan Responses: Dynamic responses when Tags are scanned, based on the Solution configuration, scanner identity, and context.
- Notifications: Real-time alerts via email, SMS, push notifications, and in-app notifications when Tags are scanned or events occur.
- Dashboard: Analytics and management tools for Tag owners.
- Shop: Purchase additional Tags and accessories.
- B2B Features: Company management, batch operations, branded Tag experiences, API access, and team management for business customers.
- Medical Features: Specialized medical alert Tags with controlled access for healthcare professionals (subject to additional verification).
6. Payment Terms
6.1 Pricing
All prices are displayed in Euros (EUR) and include applicable VAT for consumer (B2C) purchases within the European Union. B2B customers may see prices excluding VAT where applicable, with VAT calculated at checkout based on the customer's location and VAT status.
6.2 Payment Processing
Payments are processed securely through Stripe, Inc. By making a purchase, you also agree to Stripe's Terms of Service. TAGVU does not store your complete payment card details.
6.3 Subscriptions
Certain services may be offered on a subscription basis. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel subscriptions through your Account settings at any time.
6.4 Refunds
Refund requests are handled in accordance with applicable Belgian and EU consumer protection law and our Right of Withdrawal policy below.
7. Right of Withdrawal
In accordance with Belgian law (Book VI of the Code of Economic Law) and EU Directive 2011/83/EU, consumers within the European Economic Area have the right to withdraw from a distance purchase within 14 calendar days of receiving the goods, without giving any reason.
7.1 How to Exercise Your Right
To exercise your right of withdrawal, you must inform us of your decision by sending an unambiguous statement (e.g., email) to support@tag.vu. You must return the goods within 14 days of communicating your withdrawal. Goods must be returned in their original condition, unused and in original packaging where possible.
7.2 Exceptions
The right of withdrawal does not apply to:
- Personalized or engraved Tags: Tags that have been custom-engraved, printed, or otherwise personalized to your specifications cannot be returned, as they are made to your individual order (Art. VI.53, 3 Code of Economic Law).
- Digital content: Once a Tag has been activated and linked to a digital profile, the digital service component is considered delivered and the right of withdrawal for that service expires.
- Sealed goods: Tags delivered in sealed packaging that have been unsealed after delivery, where the seal is necessary for health or hygiene reasons (e.g., medical alert Tags).
7.3 Refund Timeline
Upon receiving the returned goods and verifying their condition, we will process your refund within 14 days using the same payment method as the original transaction. Shipping costs for the return are borne by the customer.
8. Intellectual Property
The Platform, including all software, design, text, graphics, logos, icons, images, and the compilation thereof, is the property of TAGVU-TAILORMADE or its licensors and is protected by Belgian and international copyright, trademark, and other intellectual property laws.
The TAGVU name, logo, and all related product and service names, design marks, and slogans are trademarks of TAGVU-TAILORMADE. You may not use these marks without our prior written consent.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purpose, subject to these Terms.
9. User Content
You retain ownership of the content you upload to the Platform (photos, text, documents). By uploading content, you grant TAGVU a worldwide, non-exclusive, royalty-free license to use, display, and transmit that content solely for the purpose of operating the Platform and providing the services you have requested (e.g., displaying your pet's photo on a Tag scan page).
You represent and warrant that you have the right to upload all content and that it does not infringe on the rights of any third party or violate any applicable law.
10. Prohibited Conduct
You agree not to:
- Use the Platform for any illegal or unauthorized purpose.
- Upload content that is defamatory, obscene, threatening, or violates the rights of others.
- Attempt to gain unauthorized access to the Platform, other accounts, or computer systems.
- Interfere with or disrupt the Platform or servers connected to it.
- Use automated tools (bots, scrapers) to access the Platform without our express permission.
- Circumvent or manipulate the Tag scanning system or associated NFC/QR protocols.
- Use the Platform to distribute spam, phishing, or malware.
- Resell or redistribute the Platform's services without authorization.
- Create false or misleading Tag profiles, especially for medical or emergency use cases.
11. B2B Specific Terms
The following additional terms apply to business customers ("B2B Customers") who use the Platform under a company account:
11.1 Company Accounts
B2B Customers may create a company account and invite team members with defined roles (owner, admin, manager, operator, viewer). The company account owner is responsible for the actions of all team members under the company account.
11.2 Tag Batches
B2B Customers may purchase Tags in batches. Batch Tags are managed under the company account and may feature custom branding, Solution configurations, and scan responses as defined in the applicable service agreement.
11.3 API Access
API access is provided subject to the TAGVU API Terms of Use available at developers.tag.vu. API keys are confidential and must not be shared. Rate limits and usage quotas apply as specified in your service agreement.
11.4 Service Level
Service level commitments, if any, are defined in the individual service agreement between TAGVU and the B2B Customer. These general Terms do not guarantee any specific uptime or response time.
11.5 Data Processing
Where TAGVU processes personal data on behalf of a B2B Customer, a separate Data Processing Agreement (DPA) applies in accordance with Article 28 GDPR. The DPA is available upon request.
12. API Usage
Access to the TAGVU API (api.tag.vu) is subject to these Terms and any additional API-specific terms published at developers.tag.vu. You agree to:
- Use the API only for lawful purposes and in accordance with the documentation.
- Not exceed the rate limits or usage quotas applicable to your account.
- Keep your API keys confidential and secure.
- Not use the API to build a competing product or service.
- Properly attribute TAGVU where required by the API documentation.
13. Limitation of Liability
To the maximum extent permitted by applicable law, including Belgian law:
- TAGVU shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Platform.
- TAGVU's total aggregate liability for all claims arising out of or related to these Terms or the Platform shall not exceed the amount you paid to TAGVU in the 12 months preceding the event giving rise to the claim.
- TAGVU is not liable for any consequences arising from the scanning or non-scanning of Tags, including in medical emergency situations. Medical alert Tags are supplementary and do not replace professional medical identification or emergency procedures.
- This limitation does not exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Belgian law.
14. Warranties and Disclaimers
The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, to the fullest extent permitted by law.
We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any content on the Platform.
Physical Tags are covered by the statutory warranty as required by Belgian consumer protection law (minimum 2 years for manufacturing defects). This warranty covers defects in materials and workmanship under normal use and does not cover damage caused by misuse, accident, or normal wear.
15. Indemnification
You agree to indemnify, defend, and hold harmless TAGVU-TAILORMADE, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Platform or violation of these Terms.
- Your violation of any third-party rights, including intellectual property rights.
- Content you upload or make available through the Platform.
- Your use of Tags in a manner not contemplated by these Terms or the applicable Solution documentation.
16. Termination
16.1 Termination by You
You may terminate your Account at any time through the Account settings or by contacting us at support@tag.vu. Upon termination, your right to use the Platform ceases immediately. Tags associated with your Account will be deactivated and scan pages will no longer display your profile data.
16.2 Termination by TAGVU
We may suspend or terminate your Account and access to the Platform immediately, without prior notice, if:
- You breach these Terms.
- We are required to do so by law.
- Your Account has been inactive for more than 24 months.
- We reasonably believe your use poses a security risk to the Platform or other Users.
16.3 Effect of Termination
Upon termination, your data will be handled in accordance with our Privacy Policy and applicable data retention obligations. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law) shall survive.
17. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. When we make material changes, we will:
- Post the updated Terms on this page with a new "Last updated" date.
- Notify registered Users via email at least 30 days before the changes take effect.
- For B2B Customers with active service agreements, provide notice as specified in the agreement.
Your continued use of the Platform after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Platform and may terminate your Account.
18. Governing Law and Dispute Resolution
18.1 Governing Law
These Terms are governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
18.2 Jurisdiction
Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Brussels, Belgium. This does not affect your statutory rights as a consumer to bring proceedings in the courts of your country of residence within the EU.
18.3 Alternative Dispute Resolution
As a consumer in the EU, you may also use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. We are willing to participate in out-of-court dispute resolution before a consumer arbitration board.
